Curtains is operated by Billion Flower Moon Studios LLC, a Wyoming limited liability company.
We respect copyright, and we expect members to post only what they have the right to post. We respond to copyright notices under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512.
1. Before you send a notice#
- An intimate image of you? Use our intimate images policy instead. It's faster, and you don't need to own the copyright.
- Someone using your photos to pretend to be you? Report the profile (how to report). Impersonation breaks our Community Guidelines, so you don't need a copyright notice.
- Is it really infringement? Some uses are allowed without permission, such as fair use. Think about that before you send a notice (section 7).
2. Our designated agent#
Send copyright notices and counter-notices to our designated agent:
Billion Flower Moon Studios LLC Attn: Copyright Agent 2106 House Ave, Cheyenne, WY 82001, USA Email: legal@curtainsdating.com Phone: +1 (307) 317-0275
Email reaches us fastest.
3. What a notice must include#
Under 17 U.S.C. §512(c)(3), your notice must be in writing and include:
- your physical or electronic signature, as the copyright owner or someone authorized to act for the owner;
- identification of the copyrighted work you say is infringed (or, if your notice covers several works, a representative list of them);
- identification of the material you say is infringing, and information reasonably sufficient for us to find it on Curtains, such as the member's name and profile ID (in the menu on their profile), whether it's a profile photo or a Scene, and when you saw it;
- your contact information, such as your address, phone number and email address;
- a statement that you have a good-faith belief that the use of the material in the way you're complaining about isn't authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you're the copyright owner or authorized to act for the owner.
If your notice is missing something, we'll tell you what so you can fix it.
4. What we do with a valid notice#
- We promptly remove the material or disable access to it.
- We promptly tell the member who posted it, and we may send them a copy of your notice, including your name and contact details.
- We record the notice against the member's account (section 6).
5. Counter-notices#
If your material was removed and you believe that was a mistake or misidentification, you can send our agent a counter-notice. Under 17 U.S.C. §512(g)(3), it must be in writing and include:
- your physical or electronic signature;
- identification of the material that was removed or disabled, and where it appeared before it was removed or disabled;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- your name, address and phone number; and
- a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you'll accept service of process from the person who sent the original notice, or their agent.
Before you send one. We send a copy of your counter-notice, including your name, address and phone number, to the person who sent the original notice. You don't have to send a counter-notice. If you think the notice is part of harassment, tell us at safety@curtainsdating.com before you send anything.
What happens next. When we receive a valid counter-notice, we promptly send a copy to the person who sent the original notice and tell them we'll restore the material in 10 business days. We restore it no sooner than 10 and no later than 14 business days after we receive your counter-notice, unless, before then, our agent hears from them that they've filed a court action seeking to stop you from infringing with that material on Curtains.
Scenes last 24 hours, so a Scene isn't restored once the 24 hours it would have lasted have passed.
6. Repeat infringers#
We terminate, in appropriate circumstances, the accounts of members who repeatedly infringe copyright. As a general rule, we terminate an account once it has received 3 valid notices within 12 months. A notice doesn't count if it was withdrawn, or if the material was restored after a counter-notice. We may terminate sooner, for example where the infringement is deliberate. A termination is a ban under our Community Guidelines.
7. False claims#
Under 17 U.S.C. §512(f), anyone who knowingly makes a material misrepresentation that material is infringing, or that it was removed by mistake or misidentification, can be liable for the damages that causes, including costs and attorneys' fees. If you're not sure, get advice before you send a notice or a counter-notice. We can't give you legal advice.
8. Other concerns#
The DMCA covers copyright only. For trademark or other intellectual property concerns, email legal@curtainsdating.com.
