Curtains is operated by Billion Flower Moon Studios LLC, a Wyoming limited liability company.
New York law requires dating services to give this notice to everyone who buys from them. We link it at every purchase and give it to every member, wherever you live.
The six rights below are in the words of New York's law. After them, we explain in plain English how each one applies to Curtains.
The Bill of Rights#
- No social referral service contract shall require the payment by you, the purchaser, of an amount greater than one thousand dollars. In addition, no such contract may extend over a period of time greater than two years.
- No social referral service contract shall require you, the purchaser, to purchase a good or service which is directly or indirectly related to the social referral service. These extra services are known as ancillary services and, while these ancillary service may be offered to you, the law prohibits the seller from requiring that you purchase this service as a condition of your social referral service contract.
- If your social referral service contract costs more than twenty-five dollars, the seller must furnish a minimum number of referrals per month to you, unless your social referral service provides the user with a search functionality or is presented with possible matches. If this minimum amount is not furnished to you for two successive months, or in the case of an online dating service with search funtionality or algorithm or location based matching, any social referral, you have the option of cancelling the contract and receiving a full refund of all the money you paid, less a cancellation fee which cannot exceed either fifteen percent of the cash price or a pro rata amount for the number of referrals furnished to you.
- Unless your social referral service contract is for online dating services that are generally available to users on a regional, national or global basis, your social referral service contract must specify the distance which you, the purchaser, are willing to travel to meet any social referral. No social referrals shall be furnished where you and the referral live at a distance greater than the distance specified in the contract.
- The provider must have an established policy to address the situation of your moving outside the area it services. This policy must be explained in your contract.
- If any provision of the social referral service contract is violated, you have the right to bring a court action against the provider which has violated the contract.
How this applies to Curtains#
1. Price and length. Our Terms never require you to pay anything, and no single purchase costs more than $1,000. No purchase commits you to anything for longer than 2 years. There are no subscriptions, and you're never charged again automatically. The Terms have no minimum term: you can stop using Curtains and close your account whenever you like. (In Arizona, Connecticut, Rhode Island and Wisconsin, each purchase and the Terms have a 12-month term that renews free; see Terms, Section 7.8.)
2. Nothing else to buy. Tickets are the only thing we sell. We never require you to buy any other goods or services as a condition of using Curtains or buying Tickets.
3. Minimum referrals. This item covers contracts that cost more than $25. Accepting our Terms costs nothing. Each Ticket purchase is a separate contract (Terms, Section 5.3), and every Ticket bundle costs less than $25. So this item doesn't apply to Curtains. You can still cancel any purchase within 3 business days for a full refund, with no cancellation fee (Cancel a purchase).
4. Distance. Curtains is a national online service, generally available across the United States (Where Curtains is available). So this item doesn't apply.
5. Moving away. Our relocation policy is in our Terms, Section 7.2:
- Moving between places where Curtains is available changes nothing.
- If you move permanently to a place Curtains doesn't serve, we close your account and refund all your unused Tickets. You can tell us at support@curtainsdating.com; you don't have to wait for us to notice.
Curtains is only for people who live where it's available. If we learn that a member lives somewhere it isn't, we close the account and refund all their unused Tickets (Terms, Section 2.3).
6. Going to court. You have that right. Our Terms don't require arbitration, and they don't waive your right to a jury trial or to bring or join a class action. You can take a claim that qualifies to small claims court in your own county at any time. For other claims, we both first try for 60 days to resolve things. Terms, Section 17 explains how, and where to file.
More New York protections, for every member#
- Cancelling. You can cancel any purchase, and the Terms themselves, within 3 business days, without a cancellation fee. We refund within 10 days after we receive your notice (New York allows 10 business days). See Cancel a purchase.
- Your personal information. Apart from what the law requires, we never sell, assign or transfer it to anyone without your prior written consent, and we don't sell it at all. By accepting the Terms, you consent in writing to the limited sharing our Privacy Policy describes: with service providers who process it only for us, and with Apple when you ask Apple for a refund (Terms, Section 7.3).
- Membership hold. You can put your membership on hold for up to 1 year. Tell us in writing, for example by emailing support@curtainsdating.com (Terms, Section 7.5).
- When your contract ends. When your account closes, for any reason, we delete your personal information as our Privacy Policy describes, and we send you a confirmation that it's been deleted (Terms, Section 7.6).
